1. Use of Our Services
You agree to use the Services only for lawful purposes and in compliance with these Terms. You must be at least 18 years old, or have consent of a parent/guardian, to make purchases or subscribe to communications. We may refuse service, terminate accounts, or cancel orders if we believe a user
violates these Terms or applicable laws.
2. Orders, Payment, and Delivery
All prices are listed in U.S. dollars. Payment is due at checkout. Accepted payment methods are shown during checkout. We strive to deliver fresh
microgreens and other products on schedule, but delivery dates are estimates and may vary due to weather, supply, or operational factors. If a product
is unavailable, we may issue a substitution or refund at our discretion.
3. Returns and Refunds
Because our products are perishable, we cannot accept returns. If your order arrives damaged, incorrect, or unsatisfactory, contact
info@harborhill.farm within 48 hours of delivery. We will replace the item or issue a refund where appropriate.

By providing your phone number and opting in to receive text messages from Harbor Hill Farm, you agree to receive recurring automated informational
and marketing SMS messages to the number provided. Message frequency varies. Message and data rates may apply. Consent is

laws. You may not reproduce, modify, or distribute our materials without written consent.
7. Limitation of Liability
To the fullest extent permitted by law, Harbor Hill Farm shall not be liable for any indirect, incidental, special, or consequential damages arising
from or related to your use of the Services or products. Our total liability for any claim shall not exceed the amount you paid to us for the specific
order giving rise to the claim.

Our products are intended for general consumption and are not designed to diagnose, treat, cure, or prevent any disease. Individual results may vary.
We do not guarantee the accuracy of third-party links, social media content, or advertising materials.
9. Governing Law and Dispute Resolution
These Terms and your use of the Services are governed by the laws of the State of Mississippi (without regard to its conflict-of-law principles) and, as applicable, the Federal Arbitration Act (FAA).
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services—including purchases from Harbor Hill Farm—will be resolved exclusively and finally by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration will be conducted by a single, neutral arbitrator in Jackson County, Mississippi (or another location the parties mutually agree to), and judgment on the award may be entered in any court with jurisdiction.
Class Action and Jury Trial Waiver. YOU AND HARBOR HILL FARM AGREE THAT ARBITRATION WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, MASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO A JURY TRIAL.
Exceptions. Either party may (a) bring an individual action in small claims court for disputes within that court’s jurisdiction, and (b) seek temporary or preliminary injunctive relief in court to prevent unauthorized use or abuse of the Services or infringement/misappropriation of intellectual property.
Opt-Out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice of your decision to opt out to: Harbor Hill Farm, 1803A Government St, Ocean Springs, MS 39564, USA, or by email to info@harborhill.farm. Your notice must include your full name, address, the phone number or email associated with your account (if any), and a clear statement that you do not wish to resolve disputes with Harbor Hill Farm through arbitration.
Severability; Survival. If any part of this Section 9 is found unenforceable, the remainder will remain in effect (except that the class action waiver may not be severed). This Section 9 survives termination of these Terms and your use of the Services.
10. Changes to These Terms
We may update these Terms periodically. When we do, we will revise the “Last Updated” date above. Continued use of the Services after changes constitutes acceptance of the updated Terms.
